1. DEFINITION OF TERMS

1.1. Public offer (hereinafter – the “Offer”) – the public offer of the Seller, addressed to an unspecified circle of persons, to conclude a contract for the sale of goods remotely with the Seller (hereinafter – the “Agreement”) on the terms contained in this Offer, including all Appendices.

1.2. Ordering the Goods on the website of the online store – items specified by the Buyer from the range of Goods offered for sale, when placing an application for the purchase of the Goods on the website of the online store or through the Operator.

2. GENERAL PROVISIONS

2.1. The online store https://creativedepo.com.ua (hereinafter – the Seller) publishes this contract, which is a public contract-offer (hereinafter the Contract) and has the appropriate legal force, on the sale of goods presented on the official website of the Seller at the address of both individuals and legal entities (hereinafter the Buyer).

In accordance with Articles 633, 641, 642 of the Civil Code of Ukraine (hereinafter referred to as the Civil Code of Ukraine) and the Rules for the sale of goods to order and outside retail or office premises, approved by the order of the Ministry of Economy of Ukraine dated 04/19/2007 No. 103, this document is an offer, and the fact of execution by the Buyer order, in oral (by phone or in a store, office) or in writing (via the website or e-mail) form and receipt of this order by the Seller – is full and unconditional acceptance of this public contract and the information presented on the website.

The use of services and the purchase of goods and services by the online store https://creativedepo.com.ua implies the consent of the person who uses the services or buys the goods with the rules, terms, restrictions and other conditions of cooperation set forth in this document.

By accepting this contract, the Buyer confirms that:

A) he turned 18 years old at the time of purchasing the goods;

B) the information provided when ordering goods or services is correct and up-to-date;

C) the provided contact information can be used for the purpose of informing about changes in work, promotional offers or other information related to the activities of the seller.

Based on the above, please read this contract (public offer) carefully and if you do not agree with any of the clauses of the offer, please leave the site.

In this Agreement, unless the content requires otherwise, the lines should be interpreted as follows:

“Offer” is a public offer of the Seller, addressed to any natural or legal person, with the aim of concluding a sales contract on the existing terms specified in the Contract.

“Product” is a list of names of the assortment presented on the official website of the Seller, but is not limited to the website.

“Seller” is a company that sells the Goods presented in the online store, but is not limited to the site.

“Buyer” is a natural or legal entity that has entered into contractual relations with the Seller on the terms specified in the Agreement.

“Acceptance” means full and unconditional acceptance by the Buyer of the terms of the Agreement.

“Order” – individual items from the assortment list of Goods specified by the Buyer when placing an application on the Seller’s website or ordered in any other way.

“Courier delivery” is the direct transfer of goods from the seller to the buyer by an independent contractor who provides services to the seller in accordance with a separate contract. The seller does not deliver the goods himself.

“Internet store” – the seller’s website https://creativedepo.com.ua

2.2. The Buyer’s order of the Goods placed on the website of the Internet store means that the Buyer agrees to all the terms of this Offer.

2.3. According to Art. 642 of the Civil Code of Ukraine by full and unconditional acceptance of the terms of this contract-offer, which confirms the conclusion of the Contract on the proposed terms, the fact that the Buyer has paid the price of the goods ordered on the website of the online store (or by other means).

2.4. The administration of the Internet store site has the right to make changes to the Offer without warning the Buyer.

2.5. The validity period of the Offer is not limited, unless otherwise indicated on the website of the online store.

2.6. The Seller provides the Buyer with complete and reliable information about the Goods, including information about the main consumer properties of the Goods.

3. PRICE OF THE GOODS

3.1. The price for each product item is indicated on the website of the online store.

3.2. The seller has the right to unilaterally change the price of any product item.

3.3. Price changes for the Goods ordered and/or paid for by the Buyer are not allowed.

3.4. The Buyer has the right to confirm or cancel the Order for the purchase of the Goods, if the price has been changed by the Seller after placing the Order.

3.5. The Recipient or the person who accepted the goods at the time of the Recipient’s absence bears all the risks associated with the loss or damage of the goods from the moment of their acceptance.

3.6. The seller has the right to transfer his rights and obligations regarding the fulfillment of orders to third parties, without releasing himself from responsibility.

3.7. The Seller is not responsible for improper use or storage of goods ordered by the Buyer on the website https://creativedepo.com.ua.

3.8. The responsibility of the Parties in other cases is determined in accordance with legislation and Ukraine.

3.9. The parties agree that any disputed situations, the resolution of which could not be reached through negotiations, are resolved in accordance with current Ukrainian legislation.

4. Privacy Policy

4.1. The Buyer’s personal data shall be processed by the Seller in accordance with the Law of Ukraine No. 2297-VI dated June 1, 2010 “On the Protection of Personal Data”.

4.2. Personal data of Buyers is collected and processed by the Seller exclusively for the purpose of selling the Goods, proper implementation of the terms of the Agreement and compliance with the current legislation of Ukraine.

4.3. In order to ensure the implementation of relations regarding the purchase and sale of Goods on the Site, the Buyer gives his consent to the Seller to transfer (distribute) his data to “NOVA POSHTA” LLC (YEDRPOU 31316718), to other transport forwarding and courier organizations, including the services of international delivery and to any Banks and/or financial institutions at the discretion of the Seller.

4.4. The owner of the personal data provided by the Buyer is a natural person-entrepreneur Levchenko Denys Volodymyrovych.

4.5. The Seller has the right to use “cookies” technology to monitor the activity of the Site and the activity of Buyers on it.

4.6. “Cookies” files do not collect confidential information and are not transferred to third parties.

4.7. The Seller takes all possible and sufficient measures to preserve the personal data of the Buyers, however, it cannot guarantee their absolute security, taking into account the peculiarities of conducting activities on the Internet.
